Terms of Use

These terms apply when you use BYR. By using the site or posting a brief you agree to them.

1. Who you're dealing with

BYR is operated by Begg Tech Group Pty Ltd trading as BYR Real Estate, ABN 71 656 734 342 ("we", "us"). You must be at least 18 and able to enter a binding agreement.

2. What BYR is and what it is not

BYR is a platform that lets buyers publish what they are looking for. Agents, owners and sellers can respond. We provide the introduction. Everything after that is between you and the other party.

We are not a real estate agent and we do not act for either side of a sale. We do not act for you. We do not represent buyers or sellers. We do not negotiate and we are not party to any contract you enter into. We do not provide legal, financial, tax, valuation or property advice. You should get your own professional advice before making a property decision.

We are commission neutral. We do not take a share of any agent's commission.

3. Your account

We use passwordless sign in. We email a single use code to the address you give us. Keep access to that mailbox secure because anyone who can read it can sign in as you. Tell us promptly if you think your account has been used without permission. Give us accurate details and keep them current.

4. Your brief and other content

  • Everything you put in a brief must be accurate and not misleading. That includes your budget, finance position and timing. Other people rely on it.
  • Do not post anything unlawful, offensive, deceptive or infringing. Do not post another person's details without their consent.
  • You keep ownership of what you post. You give us a licence to host, display and distribute it to run the service. You also give us a licence to use it in anonymised aggregated form such as demand statistics that do not identify you.
  • We can edit, hide or remove content and suspend accounts where we reasonably believe these terms have been breached or the content is inaccurate or harmful.

5. If you are an agent or owner

  • Only respond to a brief if you can genuinely help with it. No spam. No bulk pitching. No harvesting buyer details for other purposes.
  • You are responsible for holding any licence or registration your activity requires under Queensland law. You are also responsible for your own legal and disclosure obligations.
  • Do not misrepresent a property, your role, or your agency.
  • Using buyer information for marketing unrelated to their brief is not permitted. It may also breach the Spam Act 2003 (Cth) and privacy law.

6. Credits and payments (agents and owners)

To reply to a buyer brief an agent or seller uses reply credits. Replying to a brief for the first time uses one credit and opens that conversation. Follow up messages to the same buyer do not use further credits.

A credit buys the ability to contact a buyer. It does not buy a reply, an introduction that leads anywhere, a sale, or any guarantee that the buyer responds or proceeds. Buyers are under no obligation to reply or to continue. This is the same commercial risk as paying to advertise a property. You accept that risk when you spend a credit.

Credits are sold in Australian dollars through our payment provider. Prices are shown before you pay. Once a credit has been spent to open a brief it is used and is not refundable. Unused credits can be refunded at our discretion. Credits have no cash value beyond their use on BYR, are tied to your account and are not transferable.

Nothing here limits rights you have under the Australian Consumer Law that cannot be excluded, including where a paid service is not delivered.

7. No guarantees about outcomes

We do not promise that you will receive replies. We do not promise a reply will be suitable, that a property will be found, or that any transaction will complete. We do not verify what other users tell you and we do not vet properties. Do your own due diligence.

The service is provided on an "as is" basis. It may change or be interrupted or be discontinued. Parts of the service are still in development.

8. Our liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited it is limited to resupplying the service or paying the cost of having it resupplied.

To the extent the law allows we are not liable for indirect or consequential loss or lost profits or lost opportunity arising from your use of BYR or from dealings with other users.

9. Privacy

Our Privacy Policy explains how we handle personal information. That includes the fact that brief text is processed by an overseas AI provider. Please read it because it forms part of these terms.

10. Changes, termination and law

We may update these terms as the service develops. The current version is always on this page. You can stop using BYR at any time and ask us to close your account. We may suspend or close accounts that breach these terms.

These terms are governed by the laws of Queensland Australia and you submit to the courts of that state.
